1. General

Please read these Terms and Conditions carefully before ordering goods from www.alixthelabel.com. By using the Website and/or placing an order on the Website you confirm that you have read the Terms and Conditions and accept them.

We may change the Terms and Conditions from time to time without notice. You are responsible for keeping updated with changes in the Terms and Conditions. Please note that the Terms and Conditions, that are valid for your order, are always the Terms and Conditions in effect as of the time you place your order, and not a later version.

2. Terms of sale

By placing an order you are offering to purchase an item on and subject to the Terms and Conditions. All orders are subject to availability and confirmation of the order price.

Eligibility to order

You must be at least 18 years old to purchase goods on the website, be a consumer (not a reseller) and possess a valid credit or debit card issued by a bank acceptable to us. When placing an order you undertake that all details you provide to us are true and accurate. We reserve the right to cancel the contract of purchase in one of the following situations, without being liable for compensation or other costs:

  • Your payment details are incorrect or cannot be verified
  • If we suspect any fraudulent activity
  • The product ordered is unavailable from stock
  • We have the reason to believe that you are under the age of 18
  • The identification of an error within the product information, including price or promotion

If we are unable to deliver within accordance to the terms in the confirmation, we will contact you and give you the opportunity to cancel the order. If we have already received payment, we will refund you the amount.

Order confirmation

When you place an order on our Website, we will send you an order confirmation by email. Please note that the confirmation email is an acknowledgement that we have received your order, but it is not an acceptance of your order.

Once you have checked out and have received your order confirmation email, neither you nor we will be able to make any changes to your order, so please make sure that everything is correct.

Acceptance and shipping confirmation

All orders placed by you are subject to acceptance by us. Once the order has been processed, a shipping confirmation email will be sent out to you with all relevant information about your order. The shipping confirmation is our acceptance of your order.

Quality of products

We aim to describe the item(s) on the Website as correctly as possible. However, as a result of different image acquisition, display technologies or other technical reasons, minor differences in colour and other variations in item(s) are possible. Alix the Label cannot be held responsible for any such discrepancy.
 

3. Price and payment

Price

The prices shown on the Website include Dutch VAT of 21%. Prices are quoted in Euro (EUR) and do not include service, payment or delivery.

The prices shown on the Website may vary from time to time. Alix the Label is not bound by the price until Alix the Label has accepted the order by sending the shipping confirmation to you. Alix the Label reserves the right to change, limit or terminate any special offers or discounts at any time. Please note that the prices between our physical stores and the Website may vary.

Price changes

We always try and ensure that all prices on the Website are accurate, however errors may occur. If we discover an error in the price of any item(s) which you have ordered, we will notify you by email about the price change and give you the option to reconfirm your order at the correct price or cancel the order. If we are unable to contact you, your order will be cancelled. Alix the Label reserves the right to cancel any order prior to our acceptance of the order. If we have already received payment for a cancelled order, we will refund you the amount of the purchase. We are not able to compensate price differences with placing orders or returns.

Payments

We accept payments with iDeal, Maestro, Bancontact, Mastercard, Visa, Diners Discover.

When paying by card you will be asked for the card number, its period of validity and the CVC code. We make use of MasterCard Secure Code and SSL encryption, which prevent unauthorized access to card details. We do not store card numbers after the transaction has been completed. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorize payment, then you will be notified immediately at the checkout.

Tax

Please note that local charges (customs duty, sales tax) may apply, depending on your region and local customs duties. The charges are at your own expense.
 

4. Delivery

Shipping details

Shipping rates are applied per order. The exact shipping rates depend on the country to which your order is being delivered. All packages are insured and have a tracking number so the package can be tracked. This tracking number will be shared in the shipping confirmation email.

Saturday, Sunday and national holidays are not considered working days. If you have not received your delivery within the number of days shown for your country in the table above, please contact our Customer Service. Please note that we are not held responsible for any delays resulting from postal delays.
 

5. Return

Right to withdrawal

To exercise the right of withdrawal, you must inform us, about your decision to withdraw from the contract by an unequivocal statement (e.g. letter sent by post, fax or email). You may use the Withdrawal Form, but it is not mandatory. We will start to process your order as soon as it is submitted, we might not be able to prevent the shipment. Exceptions can be made only if we haven’t send you the shipping confirmation yet, so please contact us if you would like to cancel your order to see if there is a possibility to cancel.

Right of return

You have the right to return purchased items within 14 days, without giving any reason.

You cannot return items that have been purchased at our physical stores.

We don’t accept items that have been worn or used, items that have become damaged because of improper use, or items returned after the 14-day cooling-off period.   

Please fill in the Return Form included in your order and mention clearly which item(s) you would like to return. Include your Return Form in the parcel and return to our warehouse below:

Unfortunately we do not offer free returns or returns in store. You will be responsible for the postal costs of your return. Please keep a proof of postage until we confirm that your return has been delivered to us. Please note that you are responsible for the product until it reaches us, so we recommend you to send the package with a traceable service.

For any questions about your order, return or the Return Form, please contact Customer Service.

Refund information

We will refund you within 10 days after processing your return, using the same payment method you used to place your original order.

If you are returning your entire order, we will also reimburse the delivery costs (if applicable). If you return only a part of your order, we will reimburse you for the cost of the returned item only.
 

6. Damaged or defective item(s)

All item(s) come with a one-year warranty against production faults in materials and manufacture, but not wear-and-tear from regular use. This warranty period may vary depending on the statutory law of the country where the item is shipped.

If you believe you have a warranty claim concerning an online purchase, please contact Customer Service. Send them an email and include your original order number, photos of the suspected fault and a brief description of the claim. They will decide whether the damage is the result of a manufacturing defect or deviation from factory specifications. If they determine that you have a claim the item(s) will be refunded.
 

7. Website use

Errors, inaccuracies and omissions

Occasionally there may be information on our Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges and availability. At any time and without prior notice, we reserve the right to correct any errors, inaccuracies or omissions; change or update information; or cancel orders if any information is inaccurate.

Intellectual property rights

All elements on the Website are owned by or licensed to Alix the Label. All elements of the Website including (but not limited to) the general design and the content, can be protected by copyright, moral rights, database rights, trademark and other laws relating to intellectual property rights.

Limitation of liability

Alix the Label will not be liable for any indirect, direct, additional or consequential damages that may result from the use or content of our Website, including damages caused by viruses or any incorrectness or incompleteness of the information on the Website; the performance of the products; or otherwise arising in connection with the use of these Terms and Conditions, even if Alix the Label has

8. Applicable law and jurisdiction

These Terms and Conditions are in accordance with the laws of the Netherlands. In the event of a dispute or claim associated with these Terms and Conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Dutch Courts.
